New US AI hardware export bans to come into effect immediately

Nvidia has been instructed by the US government to halt its sales of AI computer chips to China. The ban, which was expected in November, will take immediate effect. Nvidia, however, claims that it does not anticipate a significant impact on its financial results due to the strong global demand for its products. The new regulations precede trade discussions between the US and China and President Xi Jinping’s upcoming visit to the US. The US aims to maintain its lead in AI by limiting China’s access to high-end AI hardware exports, including GPU chips. Other US companies are cutting off research collaborations with Chinese firms. The embargo targets various hardware related to AI, machine learning, data centers, and cloud computing. The ban affects Nvidia’s flagship A100 and H100 chips, as well as the China-friendly H800, A800, and L40S processor. Chip sales are only permitted with a license from the Department of Commerce’s Bureau of Industry and Security, which is rarely granted. The US is concerned about national security and human rights implications, particularly the potential military and intelligence uses of these technologies. The US is also urging other countries, like the Netherlands, to enforce trade embargoes against China. China’s finance ministry has expressed concerns about these export curbs to US officials. China has been actively developing its AI industry and plans to establish a self-sufficient chip manufacturing industry in the future.

New US AI Hardware Export Bans to Come into Effect Immediately

The US government has mandated that Nvidia immediately halt its AI computer chip sales to China. The ban, which was originally expected in November, comes into effect immediately. Nvidia attempted to minimize the impact of the chip ban, stating that it does not foresee a significant impact on its financial results due to the strong demand for its products worldwide.

The new regulations have been enacted ahead of trade discussions between Washington and Beijing and precede President Xi Jinping’s forthcoming visit to the US next month.

Over the past year, there has been a surge in demand for Nvidia chips, resulting in a more than 200% increase in Nvidia’s stock price. This has propelled Nvidia to become one of the world’s most highly valued businesses with a market cap exceeding $1 trillion.

Understanding the Trade Embargos

To understand these latest trade embargos, we must go back to the start of the year when the US began restricting high-end AI hardware exports to Russia, China, and Iran. The US wants to maintain its lead on China by limiting its access to GPU chips, which are instrumental to AI development.

The bans not only restrict AI-related chips but also other hardware related to AI, machine learning, data centers, and cloud computing. US firms are also severing their research collaborations with Chinese companies.

The first bans focused on high-specification AI chips, aiming to prevent Chinese companies from building supercomputers with certain performance levels. Nvidia responded by creating less powerful versions of their flagship chips specifically for China. However, the new regulations close this loophole, affecting the China-friendly versions as well as the new L40S processor.

Chip sales are still permitted if the government grants a license from the Department of Commerce’s Bureau of Industry and Security, but these licenses are seldom granted. The US is primarily concerned about these technologies being used for military and intelligence purposes.

The US is also pressuring other countries to cut off AI hardware exports to Iran, Russia, China, and the Middle East to a lesser extent. For example, the Dutch government enforced a computer chip trade embargo against China earlier this year, resulting in a Dutch company, ASML, being barred from selling its latest products to China.

China’s AI industry has been rapidly growing this year, with plans to build its own self-sufficient chip manufacturing industry in the coming years.
